Topic – Melanie will give an overview of legal considerations relevant in planning for, and implementing mine closure. This session will include the following topics:
- Sources of obligation, both the obvious and ambiguous
- Obligations that can and should be discharged vs ongoing legal risk
- Aligning closure outcomes with the ultimate goal of supporting tenement relinquishment
Presenter biography – Melanie is a partner at Herbert Smith Freehills and leads their Perth Environment, Planning and Communities team. She is an expert in land access and project approvals, environment and planning regulation, native title, cultural heritage and associated regulation. Melanie has experience advising on approvals, regulatory compliance and stakeholder issues across a range of industry sectors and Australian jurisdictions, but with a strong focus on mining and oil and gas. Melanie assists clients to effectively navigate business critical issues across the full project lifecycle and has experience supporting mine closure planning and delivery, contamination and legacy liabilities, and the development of strategies to enhance economic and/or environmental value of land post-mining while reducing post-relinquishment liability. Melanie enjoys being able to partner with clients to identify and manage legal risk strategically and maximise opportunities regulatory regimes present.
